THE GAS TAX BILL

On September 30, 2025, the Oregon Legislature approved HB 3991 which is a $3.4 billion gas/wage tax bill. Here are the three taxes in detail:

Raises gas tax 15%

From $0.40 to $0.46 per gallon. Oregon is already among the top 12 highest gas tax states.

Increases payroll wage tax 100%

Increases statewide transit payroll wage tax from 0.1% to 0.2%.

Doubles many DMV fees

Vehicle title fee from $77 to $216. Passenger vehicle fee from $43 to $85. Utility trailer or light trailer fees from $63 to $105. Moped and motorcycle fees from $44 to $86.

THE REFERENDUM PROCESS

Petitioners have created a PAC

Three Chief petitioners (State Senator Bruce Starr, State Representative Ed Deihl, and Taxpayers Association of Oregon Founder Jason Williams) have formed a Political Action Committee, Right to Vote on the Gas Tax PAC, (PO Box 512, Independence, OR 97351) to work on referring the tax to voters.

Must collect signatures for public vote

Voters will have until December 30, 2025 to collect some 78,000 valid signatures in a referendum petition drive in order to stop the tax and bring the issue to voters for a public statewide vote.

Governor can delay the process

The petition referendum effort cannot begin until Governor Tina Kotek signs HB 3991. The Governor can delay her signing until November 12, 2025. Each day she delays, she reduces the amount of time voters can collect signatures — which are due December 30, 2025.

Eligibility

Donations up to $50 per individual, or $100 per couple, are eligible for the Oregon Political Tax Credit and can receive 100% back on your Oregon taxes.

Tax credit vs deduction

A tax credit is better than a deduction!

Limitations

With a tax credit you can get 100% of your donation back. There is no limit to what you can choose to donate, but the Oregon Political Tax Credit only applies to the first $100 per couple or $50 per individual.

Deadline

If you do not use the Tax Credit you will lose it.

Restrictions

The Oregon Political Tax Credit no longer applies to tax filers with incomes exceeding $100,000 per individual or $200,000 per couple. Please consult with your tax professional about any specific questions.

TIPS ON GATHERING SIGNATURES

Signature eligibility

Voters from any Oregon county can sign any signature sheet.

Pair documents

Keep petition text with petition signature sheet at all times.

Must witness signatures

Do not leave petition unattended in public for others to sign if you are not there to witness it.

Petition copies

We prefer people not make their own extra petition copies (as they often forget to copy the petition back or they accidently shrink the size, making the petition void).

Circulators must sign

The #1 petition mistake is that people FORGET to sign at the bottom of the petition sheet as the witness (also known as the “circulator”) of the petition. For example, if you get a blank petition and you get your family and friends to sign the sheet, you must sign your name at the bottom of the petition as the circulator prior to submitting a petition. Your witness signature is simply stating that you were the person that witnessed every person signing that particular sheet. People miss this extra step and it ends up causing petitions to be voided by the hundreds. We want to inform you now so you’re aware when we mail the petitions to you.
